Filing a Florida Workers’ Compensation Claim

When you've been injured in a Florida work accident, in most cases, you will have access to Workers' Compensation benefits. This money is intended to address your most pressing medical needs, as well as some of your lost wages, disability and even vocational training in the event that you can no longer perform your previous job.

Workers' Compensation is available to you whenever you are injured while on-the-job in Florida, even if you are partially responsible for the accident and injuries (such as if you were not wearing a hardhat and were struck by an errant construction tool and suffered serious brain trauma).

There are certain requirements and guidelines that you must follow in order to collect Workers' Compensation. This includes reporting the accident to your employer in a timely manner. In general, you should never report the accident any later than 30 days, or you may risk having your claim denied.

After that, your employer has 7 days to report the accident to their insurance company. Once they receive news of your injury, the insurance company should send you information within 3 days. If everything goes as it should, you can expect to receive your first Workers' Compensation as soon as 21 days after reporting the injury to your employer.
